The only thing that would make me have any disagreement with you on this is that Belichick is supposed to be responsible for the organization; he is more than just the Head Coach -- akin to "institutional control" -- if it were only Tom Brady that would be one thing, but there are multiple parties involved and its hard to believe he wasn't aware.
I hear ya FSF, I'm just going off the report that only implicates those 3 and clears the Patriots coaches and admin of any wrongdoing or knowledge of the occurrence. Don't get me wrong, I think Bellicheat knew, but he's in the clear per the report.
What I want to know is how was Brady able to refuse his phone from being checked? The NFL and Goodell stated that there would be a full and transparent investigation. How the **** does Brady get to say no, when he's one of the people under direct investigation? This is another Goodell failure to ensure a full and transparent investigation. Now Brady and the NFL are complicit in not turning over evidence. That's pretty damning.
I'm also not sure why the texts by Brady to McNally and Jastremeski weren't released. If the investigation had their phones, they would have Brady's text to them.
Even without the direct evidence, the report shows Brady was implicit and in turn, will be punished.
PS, I read the full report. McNally will be blabbing to ESPN sometime this year. He's materialistic, and already broke NFL rules for sneakers and singed Merch by Brady (another implication of complicity by Tommy Boy).

counsel to produce McNally for the requested follow-up interview violated the club‟s obligations

cooperation with the investigation.
The investigation was conducted pursuant to the Policy on Integrity of the Game
& Enforcement of Competitive Rules. In particular, Section 2 of the Policy provides that:

investigated. Any club identifying a violation is required promptly to report the
violation, and give its full support and cooperation in any investigation. Failure to
cooperate in an investigation shall be considered conduct detrimental to the
League and will subject the offending club and responsible individual(s) to
appropriate discipline.
Section 4 of the Policy provides that “[t]he standard of proof required to find that a violation of
the competitive rules has occurred shall be a Preponderance of the Evidence.” As the Policy
makes clear, that “means that, as a whole, the fact sought to be proved is more probable than
not.”
