Actually, the only thing that was "appealed" to the court was whether or not the NFL was "allowed" to take the actions that they took under the terms of the CBA. Therefore, there should be no discussion of burden of proof or evidence as it relates to guilt or innocence. Just a standard interpretation of the terms of the contract and whether or not those terms are valid and were applied in this case in the manner proscribed in the contract.

But hey, what's wrong with a little red herring like "burden of proof" and "evidence".

And when the burden of proof is based on a preponderance of evidence it does not require a lot. There is more than enough to cover the burden in this case.

The NFL won't lose this case, though ******* Goodell is losing credibility.

The judge will grandstand some, shake his finger at both sides for the criminal waste of judicial time, and recognize that the asshats that signed the CBA will be ruled by it.

Nope. Simple thing in this case is the integrity of the game and the negative image that arises from that. Toss in failing to cooperate fully with the investigation which is the big requirement of the cba and marsha's** defense has just been deflated

That's bullcrap... the penalty is not set in stone. the Brady assertion that past practice has set it is absolutely nonsense. they cherry picked a handful of cases that had one aspect of what was going on and tried to spin it in that direction. Brady was under suspicion and destroyed potential evidence. Minnesota a ball boy tried to warm up a cold ball on the sideline... there was no sneaking it away from the refs illicitly nor did they fail to cooperate. Favre tried to obstruct an investigation into a non football matter that really didn't impact the game, especially since the image was already public.

The fact is that Brady was suspected of being part of a conspiracy to deflate balls for a competitive advantage... it doesn't matter if he gained on or not, nor does it matter if it even happened or not... the league suffered a public perception issue that he deepened by failing to be totally honest... and the lies and deceit have continued making it worse...

Beyond that the question before the court isn't whether the suspension is fair... the court has no real legal leg to stand on determining that, and if they did they would likely get knocked down in appeal like the AP one will be... its was it legal under the CBA... and thanks to dimwits who gave Goodell that power... it is

This is spot on. The judge is just yapping his gums right now. None of that matters. The only thing that matters is if the NFL can do what it did via the CBA. I can't stand the commish but if Ben can get suspended without even being questioned by police then why can't Brady be punished for cheating when everybody knows these moron ball boys didn't do it on their own. Especially since we know he and Manning lobbied the NFL to have more control of the balls. Why would they do that if they can't tell the difference in them? Seriously, it's insulting people's intelligence to say that Brady didn't know.
 
We better be prepared to play Brady on opening night in Foxboro.
 
Brady will be there week 1....and Goodell will be there for the long haul too. He's not going anywhere. They just scored high ratings for that **** show hall of fame preseason game. The owners, Kraft included, love him and the ratings and the money keeps rolling in. Up next, prime time media week for the SB and the ratings for that will be huge. And follow that with a team in LA, and everyone will love that too. Deflategate was just a show for Goodell to pretend that he's tough on the P*ts and Br*dy. He can say he tried and the courts over ruled him. It was all just a bunch of grandstanding. Vince McMahon is jealous of the huge work they just put on everybody.
 
I suspect grabitpole will be playing and the way our defense will be playing in the first game he will look like Joe ******* Montana. After that one the team will obviously go back to the lab and turn over stones and prepare to unleash hell the next week.
 
Brady will be there week 1 but he will lose this. as I said from day 1, he will appeal this as high as he can and will get an emergency injunction to play during the banner raising. he will accept the penalty later on or outright lose... go look up precedent on judges intervening in unfair suspension that do not include race, religion, or some other protected class. it doesn't happen. The AP case is likely getting overturned on appeal. Your work has a lot more ability to punish you for not cooperating than you think....

Plus as I just pointed out, Brady outright lied under oath here... his answer to goodell as to why the phone was destroyed while under oath is not what the lawyer just said.... Brady said his agent/ lawyer told him not to turn the texts over, but that the phone was destroyed as a matter of protocol, the agent just said the agent told him to destroy the phone.
 
In Brady's* mind I think he has to fight it tooth and nail to protect his legacy and "prove" to the public that he didn't cheat (again). Regardless of the outcome it's a battle he will lose everywhere outside of New England.
 
There are no ramifications (legally) for Brady lieing to the nfl. NOW in court, there is MAJOR raqmification if he lies. His integrity is / has been hit, but as far as purgery or jail time goes, not happening for lieing to the nfl. AS said, the nfl court is ONLY a work place court, so to speak. I want br*dy to purger / change / appeal / sooner or later a lier will come out. Hopefully "deep" court will let many many many things out of the bag. JUSTICE wll be served and I hopoe it goes as deep as the core of it. billicheat anyone????

This....and the circumstantial evidence is overwhelming! If Brady* doesn't care at all about how the football feels then why did he lead the fight to change the rule on how the balls are handled on the sidelines? And isn't it amazing the *'s turnover rate since the rule change?

She should leave him. He's a big-time liar. She is seeing it up close. She probably also sees that he wants to win, even if it costs him his integrity.

I kinda of hope they separate - so that she can be brought on the witness stand, if this drags out, to confess about her spouse's lying (she can do that if they're divorced, right?)...
 
Married couples can still testify against each other. They just don't have to.

it is true...your spouse does not have to testify against you in court, BUT

that only covers actions during the time married. It does not apply to actions taken prior to marriage.

Only when the harm done to the marriage would be greater than the harm done from withholding evidence.

So I think it depends on the crime and what the spouse is believed to have witnessed.
 
Ive been saying it for years: Brady, Aikman and Rodgers are in a 3 way gay relationship. I know this rumor is true because i made it up myself! lol
