NFL, union ask U.S. judge to decide on Brady suspension by Sept. 4



Tom Brady’s attorneys have filed a motion asking the court to rule on the player’s four-game DeflateGate suspension before the start of the season, the Boston Globe reports. The NFL has agreed, according to NFL Players Association attorney Jeffrey Kessler, and now it’s just up to a Southern District Court of New York to approve the motion.

By Aug. 7, each side would be required to file the motions regarding whether to uphold or overturn Brady’s four-game suspension. By Aug. 14, each side would have to file their responses to the other’s argument.T hen the sides would work together to set a date to present their oral arguments before the judge that would allow a final decision on the matter to be made by Sept. 4.

Brady has no case... they will try to befuddle the public with science that at best makes the results inconclusive, but he is basically suspended for failure to cooperate.
The league did not immediately suspend him after the issue was found. they simply launched an investigation using a very well respected independent firm. Brady and the Pats began to comply until direct evidence that could tie Brady was found and then the cooperation ceased.

The important thing to remember is that this event seriously harmed the integrity of the game and that Brady was given a very fair chance to simply turn over the texts between him and the two men that were under suspicion... not all of his texts, not his photos, just a few texts which for some reason he didn't want to do. That put the suspicion squarely on him...

Beyond that the commish absolutely has the ability to delegate power. there is nothing in the CBA that forbids it... the attempt to circumvent the CBA's stupid grant of total power to arbitration to Goodell is not going to fly. The bottom line is the NFL was justified in the suspension and even if they were not, the courts just aren't going to override this... people should also note that the last time the courts did step in was the AP case, and the NFL is expected to actually win the appeal on that because the judge overstepped his boundries making that ruling, which was far more cut and dry an abuse of the CBA procedures than Brady's case

And all that info got to Florio how? The Pats have been spinning this from the get go. The judge didn't just warn the NFL to quit leaking info... that was strongly worded to the Pats as well... its so ridiculous that when a spin doesn't catch hold in the public eye, like that nonsense about "the deflator" being about weight loss, they just try to whitewash it and go in another direction... what you are seeing here is a public divorce between the league and its favorite ***** team. the league buried so much during spygate to protect it's "integrity" and just got burned by them again and again....

Logic says Brady manipulated balls, lied to cover it up, and just wants to get away with it. You don't destroy a phone for no reason whatsoever right after being called into question over it when you are innocent
 
DEEP and HEAVY court, only way the bottom will fall out. Make the cheating ******* answer under oath, then subpoena, everything you can, including phones from other potential sources. BUT no, fast court, fast decision, fast shady br*dy. He won't get off with this, but also won't let the big cat out of the bag either. So how did the supposed leaks of information have anything to do with the leaks of air from the footballs or the fact that it was done in an effort to gain an advantage over an opponent and that it had been on going for a considerable amount of time? Thought so facts don't work use bullshit. How does any of that have anything to do with an appeal it does not. Sounds like false information has been coming from the cheatriots for a long time, "we did nothing wrong" there is some seriously false information.

Just started reading some of marsha**'s testimony and they really spend a lot of time on doctoring of the footballs to get them tacky so they can be gripped. Thanks for the link. I wonder what other components they rubbed onto the balls to make them easier to grip and more tacky. The way to fewer fumbles might be beginning to show itself inadvertently and this goes back to 2006 I believe. There are some obvious attempts to lawyer testimony given by marsha**. He has been prepared to try and make some phrases seem rather ambiguous by this coaching, a trick some in the legal profession use extensively in preparing their witnesses. It is not quite getting them to perjure themselves but it is close.

Just finished reading that mess... it went as I expected... the Brady defense tiptoed around the elephant in the room and harped on the science very heavy... when it was fairly obvious that the independent testing firm went through a ton of scenarios they kept trying to pound them on the ideal one that fits their case... and frankly the scheme of turning over text times and trying to pass it selves was just obnoxious. this is a cut and dry cover up. Brady should get a lifetime ban for jackassery

I don't really understand Steeler Nation's position on this. I understand the dislike of Brady and the Patriots, but the NFL league office (Goodell, Pash and their lawyers) are much more a potential threat to the Steelers than anything the Patriots do.

The more information that comes out about all this, the fact the NFL just does whatever the hell they want and flat out lies about it to the public is unbelievable.

I would think with all the stuff most hate about Roger Goodell, that on this issue you'd want to see Brady take this all the way to expose Goodell and his cronies as the manipulative liars they are. I don't think most of you realize how close the NFL is getting themselves ripped a new ******* by this judge on a national stage. And that MIGHT be the only thing that leads to the NFL owners to finally clean house on Park Avenue.

The more information that comes out about the Saints, the Dolphins and now the Patriots, it is just ludicrous the amount of unfair and biased practices being done just to get the answers they want and smooth over the PR (that they often create with leaks and bad information to the press).

I don't know. I think you guys are on the wrong side of this. And if more fans could see it, this might finally be the best shot at getting Goodell out of power (which I am starting to finally come around on as a good thing for the sport).
 
Just skimmed a craptastic article by Dan Wetzel on Yahoo about how "The League" has put together a shoddy investigation against the beloved and squeaky clean P*ts and Goodell has lead a witchhunt against the cleanest and nicest QB in the league. "How can any team or player ever trust the league again? And how can they allow the commissioner to be in charge of punitive assignment going forward?"

What a load of utter horseshit. Where was all this outrage when Goodell was randomly assigning punishment to any other player in the league? The Rog FINALLY gets something right and Kraft pays off a bunch of hack writers to come galloping out of the internets to undermine the entire collective bargaining agreement.

I say burn the ******* down. Call the NFL lawyers in and start questioning ALL the collective bargaining agreement. See how they like THAT ****. Every one of the benefits they fought so hard for, well, THAT doesn't look too legal. I think we should contest that ****. And by the way, we have WAY more money than you. Vet minimum ought to be what the owner feels your ******* worth. If you can make, go for it. That is if your contract allows it. Otherwise, pound ******* sand.

Don't get me wrong here Del. I think Goodell has been inconsistent for years, but this backlash has NOTHING to do with justice. This is a the P*ts and Kraft throwing a temper tantrum and paying the media to write inflammatory articles about the NFL and specifically Goodell. Ironically, they're writing the articles because Goodell finally did the right thing and held Br*dy and the P*ts accountable after years of blatant cheating. Everyone and thier ******* dog knows they've been doing it for years but Goodell has covered it up and finally something simply HAD to be done. Kraft just can't comprehend that he's not being allowed to skip again.

You want to burn down the NFL, fine. Do it but make sure the players and the teams that are responsible for the mess burn too. It's the league's pandering to this kind of blatant horseshit that's gotten them into this problem. You want to fix it, it will take a lot more than firing Goodell. Throw out the entire CBA and significantly realign players individual perceptions of how important they are to the fabric of the sport.

First off, You get arrested, you don't play. You don't play you don't get paid. You have children out of wedlock, half your salary goes to the children. Not through the mother, but through an independent law firm. That's going to change a shitload of culture immediately. I'm talking real quick and in a hurry. Imagine losing 1/2 of a 15 million dollar signing bonus just like that. You'd go buy some F'n condoms.

I see this as the ultimate win-win situation. Many Steelers fans, including myself, think the Pats got off too easily for cheating years ago and now, regardless of how serious this issue is, believe that it is great to see them get run through the mud. On the other side, Goodell has been, in my view, a bad commissioner because he has changed football too much. Further, both the Pats and Goodell have shown an arrogance that deserves to be smacked down.

So, back to my first sentence, they all look horrible in this. There is no result where they all come out looking good. It is possible one prevails and looks better than the other. However, in the end, the Pats and Brady forever will be linked to a 2nd cheating scandal and Goodell (particularly following the handling of the Rice situation last year) looks less competent, which will likely diminish his power with the owners in the future.

We just get to sit back and watch the mutually assured destruction.

Agree with a lot of this although I've consistently disagreed with your belief that the balls were not actually deflated on purpose. Those text messages were just too damning, and Brady only started to claim innocence AFTER seeing that the Wells Report lacked a smoking gun (before that he offered nothing but smirks and non-denial denials).

But both sides look absolutely terrible. Kraft may be scoring points with Pats fans, but his behavior has been absolutely clownish and classless throughout. And Goodell has turned his biggest ally into an enemy.

I don't see a judge ruling in Brady's favor because the players agreed to give Goodell unlimited power and discretion in matters involving the integrity of the game.
