Unless someone has broken a law, courts rarely intervene in disputes between private organizations and members of said private organization. In my opinion a court should refuse to hear the case, but in this case they might. Anything to make sure Brady plays in the opener.I don't think it looks good for the NFL.

I'm sure Marcia doesn't was to be suspended at all but I suspect the real agenda is to simply delay it until they play Buffalo in game 2 or Jacksonville in game 3 where they won't miss him.I think any business or organization should have the right to refuse participation or suspend its employee if they see fit. I see his recourse as getting his money back in the court. Not his participation. The NFL has deemed his behavior as bringing embarrassment to it. End of story. The legal fight should only be for lost wages.

Courts are loathe to reverse suspensions like this, even when there is ample cause to do so. the CBA and past practice arguments go out the door if the NFL argues it was suspending him for failure to cooperate, not for the actual event of deflating balls. We know courts have upheld suspensions for people who have refused to allow employers to search vehicles and bags before when reasonable evidence existed that something might be in there on their property. I think there are two they might get a favorable ruling in, Massachusetts, for obvious reasons, and Minnesota, though Im sure the league will fight for a change of venue to New York.
I think too many people are applying criminal law standards to a civil case that courts traditionally shy away from.
