Tom Brady on the field for Week 1 against the Steelers? It's looking more likely

The American Enterprise Institute (AEI) issued a report yesterday slamming the Wells report, and perhaps paving the way to a reduced or completely suspended punishment for the Patriots star quarterback alleged involvement in the illegal deflation of footballs.

AEI found the Wells report was flawed because of the statistical procedure used to determine that Patriots footballs had deflated significantly more than the Colts' during the course of the game that precipitated the original investigation. It also found Ted Wells failed to investigate all "relevant" scenarios related to the pressure of the footballs. One such scenario is ambient temperature and the timing of the pressure checks. Temperature is a factor the Patriots organization cited the wake of the initial accusations earlier in the year.

The authors of the report concluded, "It is therefore unlikely that the Patriots deflated the footballs." The AEI's report did not address the text messages cited in the Wells report that shed light on Brady's preferred ball pressure and gifts he may have been providing to staff members to deflate NFL gameday footballs. Nonetheless the authors of the AEI report wrote in a June 12 New York Times opinion piece, "When the NFL hears Mr. Brady's appeal of his suspension later this month, it should proceed with the knowledge that the Wells report is unreliable."

AEI is the same organization that found fault with the NFL's report on Bountygate, a scandal allegedly involved players from the New Orleans Saints were receiving bounties for injuring players from opposing teams. That particular report found that the Saints players injured fewer players than all but one team during the first year the bounty program was in place. It is important to note, that when Paul Tagliabue suspended the punishments of the players involved, he affirmed the original conclusions that players had indeed been involved in a payments-for-injury scheme. The reason the suspensions were overturned was because of Goodell's arbitrariness in determining a consequence.

The AEI report was released just in time for Brady's June 23 appeal hearing. Though there was other evidence in the Wells report that was not disputed by the AEI report, its findings could still strengthen Brady's case. There have also been several other indications beyond this latest report that Brady's suspension could be reduced or suspended. DeMaurice Smith of the NFLPA questioned the neutrality of the Wells report at the end of May while Roger Goodell left the door open for a reduced sentence if Brady ended up being more cooperative, per Foxsports.com

What does this mean for the first game of the regular season? June 23, the date of his appeal, should bring more concrete information. Until then, the odds are steadily increasing that Tom Brady will be on the field for the opening game against the Steelers.

AEI forgets Goodell runs things how he sees fit and often throws darts at a dart board.

Not that Brady couldn't serve his suspension game 2 thru 4 with a brief punishment delay.

Still tired of this overall as everyone knows that franchise bends and breaks rules habitually.

It will take Goodell leaving to right the ship (better decision making)and we know that isn't happening anytime soon.

I still wouldn't be surprised if the Rogmeister finds a way to let Brady play against us. Either he will be suspended for preseason games or his case will *cough* still be under appeal *cough* at the time of the season opener. Rogmeister can NOT have his least favorite team beating his favorite team over a silly thing like a few footballs being low on air.
 
This thing isn't about facts anymore. This is about public opinion now. I think there is enough public opinion towards reducing the suspension. I could see it being down to two. It can't go away. If they have a meeting and it goes away, that would be really hard for the public to swallow because the whole thing is very polarizing. When I talk to people they either think it is ridiculous or not enough. I would imagine the appeal will be a few hours long. say even a day. Pretty hard to drag out a decision about a day's proceedings for over two months. Roger will probably reduce by a game, maybe two. He can't possibly take it away without some rock solid smoking gun evidence that literally almost everyone would agree on. He is painted in a corner.

AEI sounds like a junk science institute that will find what ever you tell them to find, there are lots of them out there. When I was doing accident reconstruction the shysters with no case would hire these guys and they would bring up all kinds of **** that had no bearing on anything. One case I worked on involved an engineer that stated I did not take into account the relative humidity and temperature and how that would effect the speed calculations. I was at the scene of the accident in less than an hour and the temperature likely did not change by more than one degree and the humidity likely not at all. I suspect the guys from that were former FBI trained investigators were more than competent to determine what was going on. Particularly when phone conversations would indicate wrong doing was going on and needed to be concealed from the zebras, enough said.

I think the only public opinion that is in favor of that are the fans of the cheatriots any one else will accept reality.

Lawyer? This isn't a court of law, its the NFL. The NFL can tell good lawyers to go F themselves.

Personally, I hope he plays and suffers a season-ending injury without being touched.

This isn't criminal law... its a private business... moreover one governed by a CBA... courts are fairly reluctant to meddle in suspension issues like this... its not the slam dunk people think that the case will even get heard if Brady brought it... this is all just a ploy to get a one game injunction so he can play in the banner raising game. Goodell is probably in on it.

I understand its not a court of law, but I would bet Brady has sought legal counsel in one way or another to prepare his "defense."

This is a much lower standard than reasonable doubt. It is not a criminal court. Preponderance of evidence.......more likely than not is the applicable standard here.
 
Well I for one hope the guy plays in game one. If he doesn't play then its a no win for us. If we lose then everyone will say we let a nobody like Garafalo or whatever his name is beat us. If we win then its, sure they beat us with our backup and if Brady was playing they wouldn't have had a chance. No, I want the little yo yo to play and I'd like to see us put him on his *** all night. I don't want any excuses and Ben is right. The game is not the same without Brwady starting.
