Just out of curiosity, what other specific part of the Consitution do you walk around with printed on your t-shirt in big, bold, black letters? You guys take that 2nd amendment to heart, like there's no tomorrow. Anything else out there of interest beyond having the right to arm ourselves to the teeth?
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
I know you may not like the amendment, Tibs, but the 2nd amendment is damn clear. More clear, by far, in its prescriptive statement about the right of citizens to "keep and bear arms" than the 4th amendment, for example:
"
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
The 4th amendment says nothing about suppressing evidence illegally obtained, does it, Tibs? Yet the Supreme Court has held that the amendment must be enforced, and that requires "giving it teeth." Hence, the rule that evidence obtained in violation of the 4th amendment - and all evidence that flowed from the illegally-obtained evidence under the doctrine known as "fruit of the poisonous tree" - must be withheld from the jury. Otherwise, the protection against unreasonable search-and-seizure provided by the 4th amendment is illusory.
Compare that to the 2nd amendment, Tibs. The 2nd amendment plainly mandates, "
the right of the people to keep and bear Arms, shall not be infringed." SHALL NOT BE INFRINGED.
I get that you think the amendment should be revisited in light of semi-automatic weapons, compared to muskets that took 60 seconds to reload, but the Constitution does not work that way. We cannot simply ignore portions we find problematic, and essentially make it up as we go. The Constitution is the sole source of power the Federal government has over me, Tibs - the sole source. If the government can ignore the Constitution, why the hell am I obligated to obey their rules?*
* It's a trick question. The answer is, if the Federal government expects me to play by the rules, they can damn well play by the same rules. Otherwise, **** 'em.
