An Indianapolis Colts linebacker has been charged with rape, according to court documents filed today by the Marion Co. prosecutor.

Josh McNary, 26, who has been with the team since 2013, faces one count of rape, one count of criminal confinement and one count of battery, court documents state.


the incident in question happened on or around December 1.

The victim told Indianapolis Metropolitan Police Department (IMPD) sex crimes detectives that she met an unknown man at a downtown bar and went to his apartment. She says that a fight broke out before McNary allegedly raped her.

She took his cell phone when leaving his apartment.

A hospital examination reveled that the woman suffered injuries, including dried blood behind her ear. She told police she scratched her attacker. The victim told police that when she scratched McNary, he said, “Look what you did to me.”

She also informed police that she was intoxicated at the time of the incident.

Police used the cell phone to make the connection to McNary. When police arrived at his apartment, McNary told them, “I know why you are here.”

wait... a rape case with actual charges filed??? and facts and proof and stuff... wow, what a novel concept... fortunately they are playing the Patriots, so the hammer can fall quickly

The article I read was pretty weird. The dude said he was expecting them and had saved evidence from the night. Not sure what the evidence is but he must have known she might try to pull this crap. Again, it looks to be a "he said, she said" deal that can't be proven without witnesses.
 
His injuries make it seem like he's guilty. It's either that or ***** be cray.

The article on CNN said that the "evidence" was the bedding (sheets and stuff), which was balled up on the floor in front of the washing machine. There was apparently blood on the sheets. They also found articles of her clothing and an earring. When she left, she also mistakenly took his cell phone with her, and that's how police contacted him the next day.
 
Not sure how he is toast. She was drunk. It is "he said, she said". There is no evidence. A scratch means nothing. Some women do that. From the little I have seen, any good attorney could get him acquitted.

Colts' Josh McNary placed on exempt list after rape charge

Indianapolis Colts linebacker Josh McNary has been placed on the commissioner's exempt list, one day after he was taken into police custody on allegations he raped a woman last month.

"This action was taken pursuant to the Personal Conduct Policy with the support of the Colts following the filing of formal charges against Mr. McNary by the Prosecuting Attorney of Marion County, Indiana," the NFL said in a statement. "McNary was charged yesterday afternoon with felony counts of rape and criminal confinement, and a misdemeanor count of battery resulting in bodily injury. The Colts have expressed the club's full support for this action."

"The Colts sincerely hope this extraordinarily serious matter will be resolved expeditiously and that justice will prevail," the Colts said in a statement.

Is there a difference?

Some people are the HERD !!!!!!! I'm hearing yaz about society, No one takes responsibility for their actions. It's never their fault. Someone tresspasses on YOUR property, trips and fall into cactus, then wants to sue you as it's your fault, they got cactus quils in them. OR they tresspass, can't read the electric fence (for keping cattle / horses) warnings, then get shocked, then BLAME you for their stupid actions. Flucked up as someone actually rooting for the cheatriots to win. GO FIGURE
