If he is indeed indicted with possession of cocaine thats a mandatory 3-7 year prison term. He isn’t getting out of it unless Chung says it was planted.

Yes, a defendant can be indicted without being arrested. Most organized crime defendants are handled just that way, to avoid tipping them off before the indictment. The grand jury, upon a finding of probable cause, can issue the arrest warrant.
