When a suit has been filed it is a court case. A suit has been filed in this matter. It is a court case. Freedom of speech is one of the amendments to the constitution everyone must abide by it unless it has been modified by contractual agreement entered into by both parties. Common examples are non disclosure agreements regarding information that is deemed to belong to one of the parties, information classified as secret by the government, information protected by a gag order issued by a court. In those instances as well as others information can be protected and excluded from free speech. With regard to your comment about it not applying here I am still not sure what point you are trying to make with your original comment about free speech having anything at all to do with a point you were trying to make. My point was free speech has nothing to do with concealing evidence. The only protections one has regarding protected speech is provided under the search and seizure laws that I mentioned above and they do not apply in this instance. It is just more bullshit from the marsha** camp in an effort to confuse public opinion and nothing more. This is the bill clinton approach to honesty.

My point is that legal rights that citizens have to protect them from government don't carry over to private enterprise all the time. Freedom of speech is just one aspect that gets misused all the time... as does illegal search and seizure or invasion of privacy.

IE....Post on facebook that you think your boss is an ******* and totally incompetent... see if you get fired or suspended... heck have an NFL player or coach say the refs sucked, see if they get fined... freedom of speech doesn't apply to workplace environments... Hell, there have been people fired for taking part in a public protest for non PC agendas... totally legal to do in most cases... totally legal for a workplace to decide that's not how they want to be represented. There are a handful of protected classes that get heightened rights within the workforce, but none of them apply here.

There are people who consistently claim the NFL cant suspend him for him asserting his right to privacy on his phone... that is not correct. The NFL was well within its rights to ask Brady to give them the ability to stop a very harmful public image from circulating and instead he reinforced it by refusing to cooperate.
 
The other point is, the lawsuit isn't really about whether the suspension was just or not... the court isn't probably going to consider that at all, just whether the process to do it was correctly applied....
