Article discusses a settlement regarding the cheating of marsha**. They are willing to pay a fine with no suspension. The threat is a lawsuit and an injunction against the nfl. One way around this might be for the NFL to actually say go ahead. They could follow it with, any games played while the injunction is in effect will result in forfeiture of games he participates in in any way to include being in the stadium or practicing with the team or being at their facilities any time during the week. So if he attempts to use a stall tactic to make the suspension meaningless the team will pay a huge penalty in playoff chances this season. If the matter is not solved by the playoffs the team is ineligible to participate. Let them chew on that.

Is that how the law works?

The entire thing is ridiculous and was way overblown, but it is what it is now and the NFL is going to look incredibly weak if they change a four-game suspension to no suspension because of the threat of a lawsuit. It also sets a precedence for other players and future issues.

If he is willing to pay the fine, then he is guilty. So he is guilty enough to pay a fine, but not to miss games?
 
meh this continues to play out to the script I imagined when it first broke... Goodell and the Kraft cronies are nothing if not predictable...
 
So I just heard Peter king on the kdka news talk how he thinks the NFL fears the fact that no matter what decision they make this is not going away... Seriously .... they created this problem by letting the * pats get away with cheating for YEARS.. He also said that all the evidence
is circumstantial ....DUH wasn't that the same thing with Ben's suspension ,,,, no proof there was any wrong doing ... Regardless what happens Marcia will be playing the first game of the season....which sucks but not the because he will probably play but because.. Well I am too much a lady to put in print what I really think !!!!!

Like I said, I think the objective is to delay things enough that he plays against us and if he gets suspended it is later when they play a bad team,.

The NFL has created this problem because their punishment system has been way too arbitrary and confusing.

Even if they collectively bargain that Goodell can be judge, jury and executioner, that still doesn't hold up in court/arbitration if he's completely crazy and inconsistent in his rulings.

There's a reason the NFL is losing every time a player takes them to court. And now that players have shown how to defeat them, there's no reason anyone suspended just doesn't sue the crap out of them.

The NFL's policy of punishment based on whichever way the media/fan wind blows has been flawed for YEARS. Despite the hatred here of all things Patriots there is no way (based on historical context) that this is a 4-game violation. The Vikings got a $25,000 fine for heating/drying (which increases pressure) balls just last year. And there has NEVER been a solid, scientifically accurate modus operendi when it comes to ball pressure during games. To just randomly measure football pressure in ONE game at halftime (I'm not sure this has ever been done before) and conclude something is wrong is the most illogical thing ever and will never stand up to courtroom scrutiny.

If players were smart they would have sued like crazy back when the league just decided arbitrarily to increase fines for big hits by a factor of 10 halfway in the middle of a season too, but the NFLPA were ******* looking for a new deal.

Now that the CBA is in place for the next half decade, players can sue and change the precedent of all things Roger Goodell. And that's exactly what is happening. The NFL's legal team is in total retreat mode because they bit off WAY more than they could legally chew.
 
Well, reporter out of Miami (citing S.A. Smith report) says that the NFL is going to keep the 4 game suspension in effect and has no fear of Brady taking the matter to federal court. Apparently one of the reasons they don't fear a court overturning their ruling is that Brady destroyed his cell phone to keep investigators from getting his text messages.

I'd love for the phone destroying part to be true. That would damn him forever. But even if it is true, I'm sure they (Brady's camp and the league) will find a way to bury that info in an effort to have him keep his rep intact for the hall of fame.
 
Didn't know he actually destroyed his cell phone. As I have said all along, the court can potentially say something about the findings in the report but they have nothing to say about the NFL rule that Marsha violated in regards to not cooperating. I would think destroying ones cell phone would absolutely fall into that category.

And then watch the H.O.F. slowly recede for a decade or two Tom. Hell, you may NEVER get in. You and Pete Rose can get together and drink yourselves silly bitchin about "Tha Man!"

The irony is, people forget that Elliot Ness brought down Al Capone with f'n Tax Evasion.

EDIT: I was apparently wrong. Elliot Ness did apply a great deal of pressure to Capone and distracted him, to be sure, but it seems that the tax evasion work and ultimately the conviction that got the ball rolling was largely due to the efforts of US Attorney George Johnson and IRS Agent Frank Wilson. However after Capone's empire began to crumble Ness did secure a large number of Volstead Act violations (Prohibition). It seems they were all dropped though and the IRS thing stuck.

It doesn't matter - if the NFL believes Brady was being un-cooperative by hiding evidence, they can slam that 4 game suspension up his poop schute on that alone....that's what this report sounds like.

Shocking, Now it depends if court will hear his case.
 
Tom will be playing week 1 and the season while they work their way thru this mess.. I.don't for a second doubt Brady plays the entire year...hell I could see them tying it up it the courts for a couple of years ...by then ******** may be ready to retire...this was the plan all along make it look like Goobs was being tough...they knew it would end up in court and Brady would continue to play
 
hope Brady's suspension stays or there should be riots. Just read the new posts, good thing they slammed the bwady boy
 
Still much too light a penalty. Should get 4 more games for bad behavior and trying to avoid cooperation via the courts. Kraft would go up a bit in the eyes of the nfl if he sat marsha** if he does get an injunction.
